A Barbourville man was arrested after a minor came forward to report him for sexually assaulting her on two separate occasions.
The victim, a 17-year-old female, went to the Barbourville Police Department on Sunday stating that a man had twice penetrated her with his finger on September 8 and 16.
Brian Newman, 24, was located by Kentucky State Police at his residence around 6 a.m. He was advised of his Miranda Rights and agreed to speak with police.
Newman initially denied committing any sexual acts with the victim. He later admitted to touching the girl’s pubic hair but denied penetrating her vagina, stating he “couldn’t get his hand far enough in the victim’s pants.” Newman also claimed to have stopped when asked.
According to the arrest citation, the victim has a diagnosed disability and has difficulty communicating.
A recording provided to police by the victim appears to reveal Newman asking to touch the victim’s breasts and asking to lick and touch her. In the recording the victim tells Newman “no” multiple times. She reported that he did penetrate her and that she told him to stop multiple times.
Newman was charged with first degree rape and lodged in the Knox County Detention Center. He is currently held on a $25,000 cash bond with the stipulation of home incarceration. He will appear in court on September 29.
